An appeals hearing held on April 9, 2026, in a Manhattan courtroom could determine whether Sean “Diddy” Combs is released from prison far earlier than expected, with legal experts and Hollywood neighbors alike closely watching the outcome. Combs was not present in the room. His attorney, Alexander Shapiro, appeared before a three-judge panel of the Second US Circuit Court of Appeals for two hours of arguments. The defense argued that the jury acquitted Combs of the most serious allegations, including coercion, threats, and physical violence. The trial judge, Arun Subramanian, still used that acquitted conduct when deciding the length of the sentence, which the defense claims was improper. They described the “freak-offs” at the center of the case as “highly choreographed sexual performances involving the use of costumes, role-play, and staged lighting, which were filmed so Combs and his girlfriends could watch this amateur pornography later. ”
Since adult pornography is constitutionally protected, the defense contends the Mann Act should not apply. They argue Combs was not paying sex workers to have sex with him but to perform with his girlfriends while he watched and filmed. Prosecutors called the argument meritless, saying Combs was “hiring commercial sex workers for his own sexual gratification” and was not running a film company.
CNN legal analysts warned that accepting the argument could create a loophole allowing anyone who films a prostitution situation to claim First Amendment protection. Meanwhile, some celebrities who stayed silent after Combs’ arrest have begun speaking positively about him in recent weeks. Artists including Usher, Young Miami, and J. Cole have said publicly they have nothing negative to say about their personal experiences with him.
50 Cent is in a different position. He released the Netflix documentary series “Sean Combs: The Reckoning,” which became one of the platform’s most-watched programs. If Combs is freed, tensions between the two could escalate. Residents of Holmby Hills, the ultra-exclusive Los Angeles neighborhood where Combs owns a mansion, are reportedly concerned.
TMZ sources said neighbors worry about media attention and chaos returning if he is released. Combs’ children have already drawn police visits due to noise complaints from parties at the property. Real estate agents in the area are now legally required to disclose to potential buyers that Combs’ mansion is nearby. The association with his case has become a “material fact” that could affect property values, making some homes harder to sell.
There are three possible outcomes from the appeals hearing. The conviction could be overturned entirely, which would result in Combs’ immediate release. The sentence could be reduced, sending the case back to the lower court for re-sentencing without the acquitted conduct. Or the sentence could be upheld, meaning Combs remains at Fort Dix until April 15, 2028.
The Bureau of Prisons has already moved his release date up by 10 days this month, from April 25 to April 15, 2028. Good behavior credits and completion of a drug rehabilitation program could also shorten his time.
